Terms of Service

Agreement

These Terms govern your use of Kahu apps published by Ikaika Creative Pty Ltd ("Kahu", "we"). By installing a Kahu app on your Shopify store, you agree to these Terms.

The service

Kahu provides Shopify apps (currently Kahu Loyalty) that integrate with your Shopify store via authorised OAuth scopes. We may add or remove features over reasonable notice.

Your responsibilities

• You operate a legitimate Shopify store and have authority to install apps on it.
• You comply with Shopify's Terms of Service and Acceptable Use Policy.
• You communicate loyalty-program terms (earn rates, expiry, redemption rules) clearly to your shoppers.

Billing

App subscriptions are billed through Shopify's Billing API. Charges appear on your Shopify invoice. Cancel anytime from your Shopify admin; cancellation takes effect at the end of the current billing period. We do not process payments outside Shopify.

Data

Our handling of personal data is described in the Privacy Policy. You remain the data controller for your customers' data; we act as a processor.

Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance and will minimise impact where possible.

Liability

To the maximum extent permitted by law, Kahu's aggregate liability for any claim arising from your use of the apps is limited to the fees you paid us in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Termination

You may uninstall the app at any time from your Shopify admin. We may suspend or terminate access for violation of these Terms or Shopify's policies. On uninstall, we delete shop data per Shopify's shop/redact webhook timeline.

Governing law

These Terms are governed by the laws of Queensland, Australia.
